JZK, Inc. case granted Summary Judgment – will not go to trial

Judge Tabor heard motions for summary judgment by both parties today [Friday, June 28, 2013]. Both JZK, Inc. and Virginia Coverdale submitted pleadings arguing that the case could be settled as a matter of law rather than proceed to trial.

Judge Tabor agreed, noting that the relevant facts were not in dispute. In his ruling, Judge Tabor noted that the defendant had not sufficiently established the points of law in their favor, while also noting that JZK, Inc. had more than adequately done so. He found the Conditions of Participation to be reasonable. He stated that protecting one’s proprietary information is an important concern that may be addressed in a contract and that RSE’s contract was “sufficient to prevent this type of disclosure.”

Since it was undisputed that Coverdale had agreed not to disclose such information when she signed the contract, and then later did so, Judge Tabor granted JZK, Inc.’s motion for summary judgment, ending the case. There will be no trial.

“I am elated that the Court saw this was a simple case of a breach of contract,” said JZ Knight, President of JZK, Inc.

Under the Conditions of Participation she signed, Coverdale promised to pay JZK, Inc. their attorney’s fees and the court costs. And while she may appeal Judge Tabor’s decision within the next 30 days, there are a number of high hurdles she must face if she chooses to do so.

“JZ Knight is not a person of interest in a Thurston County Sheriff’s Office murder investigation, sheriff’s spokesman Greg Elwin said today [May 16].

‘Her name certainly has come up in the investigation, but she is not a person of interest,’ Elwin said.

Elwin said the sheriff’s office is investigating the 1992 murder of Joe Sumrall after receiving new information on the case.

‘Within the last several months we’ve received new information regarding the Sumrall homicide and that’s what we’re investigating, seeing if any of this new information might yield new clues or information that might help solve the case,’ he said. ‘Some of that information has included JZ Knight’s name, but nothing that causes us to consider her a suspect or person of interest in any way.”

“According to court documents, Coverdale allegedly posted on a Facebook group that she had spoken to a woman who claimed her husband murdered someone in Tenino, allegedly at the request of JZ Knight. Lawyers for JZK, Inc. asked Coverdale to name the alleged witness during a deposition interview and she refused, according to court documents.”

“An attorney for a former student of Ramtha’s School of Enlightenment
is barred from asking the school’s leader, JZ Knight,
about alleged practices such as encouraging students to drink a liquid containing lye that,
according to the former student’s affidavit, is supposed to ‘accelerate our individual enlightenment.’”

“Thurston County Superior Court Judge Gary Tabor ruled Friday {February 1] in anticipation of Knight’s videotaped deposition that will be part of a breach-of-contract lawsuit brought by JZK Inc. against former student Virginia Coverdale.

Tabor ruled that during Knight’s deposition, Coverdale’s attorney, Shawn Newman, can ask Knight only questions that are directly relevant to the lawsuit. The suit seeks damages in response to Coverdale’s release of videos showing Knight making derogatory comments about Mexicans, Catholics and others last year.”

The group has now threatened to post a new video that includes several hours of footage from an online event sponsored by the School. The School’s attorneys believe that this may violate copyright law and be in breach of a contract signed by one of the group’s members. The School is investigating and will seek legal protection if necessary.

Dave Champagne, the brother of Virginia Coverdale, contacted the media earlier this week but they did not share his side of Virginia’s story. He and his family asked RSE to forward his letter to you.

I was a student in the Ramtha School for approximately ten years, from 1991 to 2001. I am not a current student and don’t represent the school. I remember the Ramtha School as very unorthodox but as a place of peace and empowerment. Although I no longer attend the school, most of my friends and family have attended at one time and we all think the world of the work they do there.

Virginia Coverdale is my sister. She is largely responsible for the creation and distribution of recent videos about the Ramtha School. These videos are deliberately edited to make it seem that the school is a dangerous haven for child abuse and homophobia. Firsthand I can say that is not even remotely true.

I am deeply saddened that my sister has allowed her personal unresolved hurts and grudges to taint and distort the truth and actions of this school of thousands of innocent people worldwide, many of whom I know to be decent and loving people. What is more disturbing to me — and the reason I am finally speaking up after many months of silence — is that the motivation for my sister’s actions is based purely on bitterness and anger.

Virginia had an affair with JZ Knight’s partner, James Flick, a couple of years ago. James had left my sister within weeks of the affair being found out. She felt humiliated and became rageful and angry, not just at James but at JZ Knight as well. Virginia spent much of her time obsessing over them both and she couldn’t let it go. In the past year Virginia’s obsession took the form of blogging with other disenfranchised ex-Ramtha School students about JZ Knight.

A few months ago, she told me and my family that she was working on the Andrew Barkis Campaign for Thurston County Commissioner. She said she was hoping if she did a good job helping him get elected, he would offer her a job after the election. We were all glad she was pursuing productive work and getting on with her life. She said part of her objective was to oust current County Commissioner Sandra Romero.

When we saw the videos she posted on YouTube and distributed to state and local officials, we were shocked and sickened but we were not surprised. I tried to convince myself this was just dirty politics . . . but the videos clearly showed us that she is taking her rage against JZ and the Ramtha School to a broader audience under the guise of a political agenda. Sandra Romero and the campaign against her was just a convenient excuse.

I never wanted to have to say these deeply personal things about my sister but I just can’t allow such blatant distortions of the Ramtha School to go undefended by someone who has both been there and knows Virginia’s motivations.

I’d like to add that I know BOTH Sandra Romero and Andrew Barkis personally. I don’t feel either one of them deserves to be attacked in any manner like this. Sandra Romero, especially, has my deepest sympathies.”

Austin Jenkins, Olympia reporter for KUOW radio 94.9 FM in Seattle (a founding member of National Public Radio, NPR) interviewed JZ Knight on Friday, August 31 in a story titled:

“New age spiritual leader risks ‘ridicule’ to support Washington Dems”

“She is perhaps the Northwest’s most famous new age spiritual leader. JZ Knight of the Ramtha School of Enlightenment in Southwest Washington. Now Knight has a new role: major political donor. She recently wrote a $50,000 check to the state Democratic Party.

JZ Knight says she’s always been political. But she was reluctant to associate herself with the candidates she supports.

‘Here’s bluntly the reason. I have not wanted to openly support candidates because I was worried that the backlash because I supported them would hurt them because of people’s ignorant perceptions about me.’”

“‘The sadness I have is that though I’m a taxpaying citizen of Washington state, that I’m ridiculed for what I’m doing.’

Knight is concerned about a range of issues including: women’s rights, the environment, and voter ID laws. In recent years, she says she’s become a significant donor to national Democratic causes.

But this year -– for the first time — she’s also putting her money into Washington state politics, including direct contributions to a few individual candidates.

‘I just felt like it was time to give the Democrats equal funding to what the donors of the Republican Party are throwing into this state.'”

“The Supreme Court has ruled that mystic teacher and author JZ Knight has standing to oppose several proposals to subdivide property into single-family residential lots in Yelm. The hearing examiner granted preliminary subdivision approvals in five decisions. Knight later filed a Land Use Petition Act challenge, and the trial court ruled in her favor. On appeal, the Court of Appeals held that Knight could not show she would personally be harmed by land use decision, thus requiring dismissal of her LUPA petition. In a 7-2 decision by Justice Charles Wiggins, the Supreme Court held that Knight established that the land use decision is likely to prejudice her water rights and satisfies the statutory standing requirement.”

JZ Knight’s Legal Team Responds To Local Newspaper

JZ Knight appealed the City of Yelm’s decision granting preliminary plat approval to five subdivisions totaling 568 residential units because of the City’s failure to show adequate water availability as required under state law and City code.

Thurston County Superior Judge Wickham issued a final judgment prohibiting the City from delaying proof of water availability for these five plats until the time of building permit/water connection approvals for individual lots within the plats.

The City appealed that decision to the Appeals Court.

JZ Knight’s legal team issued this response to Megan Hansen’s front-page story in today’s Nisqually Valley News:

“JZ Knight has not been ordered to pay $195,000 in attorney fees and costs, as reported in the Nisqually Valley News. No court order setting the amount of a fee award has been issued. The Court of Appeals decision on the land use appeal allowed the City and Tahoma Terra to submit requests for “reasonable” attorney fees and costs. Their requests for fees were submitted, but Knight has an opportunity to submit objections to the fee requests. These objections are due to be filed by June 28th. A court ruling on a fee award is expected within two weeks. Knight’s attorneys do not expect the court to award the City and Tahoma Terra the amount of fees they requested.”
